Spotlight On! Immigration and Criminal Defense Attorney Cynthia Santiago

This is another installment of the series, Spotlight On! A series where we showcases Latina lawyers and learn about the early successes in their careers.

Today I’m excited to share a little bit about Cynthia Santiago, an immigration and criminal defense attorney.  I “met” Cynthia through Instagram and was impressed by her hustle through her solo practice and her community engagement, see Cynthia’s decision to give her answers in English and Spanish, which highlights her desire to ensure everyone in the community is informed and aware.  Once I learned that she had previously ran for political office I knew it was necessary to share her journey with everyone!

When did you start practicing?  

I have been practicing law since 2012.

What area of law do you practice?

I focus on immigration and criminal law defense.

Me enfoco en defensa migratoria y penal.

What is a typical day like for you in your work?

There is no such thing as a typical day when you have your own law practice. Every day there are needs that arise in immigration or criminal defense that vary. One day you may have not have many consultations with new clients, but may have deadlines for upcoming court hearings or immigration packets to prepare for clients. Other days you may have a family call you with an emergency because their loved one is detained and they want to know if we can stop the deportation or they may have a criminal court hearing the next day. The needs of our community vary from day to day, but that is why organization, time management, and support staff is extremely important.

No existe un día normal cuando uno dirige su propia oficina, cada día hay una necesidad diferente cuando viene a la defensa migratoria y penal. Un día tal vez no tengo muchas consultas pero tengo que prepararme para alguna audiencia de corte o preparar solicitudes migratorias para mis clientes. Otros días puede que tenga una familia que me llama de emergencia porque su ser querido esta detenido y quieren saber si se puede parar la deportación o tal vez su familiar tiene una audiencia con la corte penal el siguiente día. Las necesidades *de nuestra comunidad cambian de día a día, pero por eso es muy importante organizar, administrar bien mi tiempo, y tener ayudantes.

 How did you get started in this area of law?

I initially wanted to become a public defender. I witnessed the effects of incarceration when my brother, who was 18 years old at the time, was sentenced to prison time for a crime he did not commit. I set goals to become a public defender but throughout the years I began to see the limitations a public defender has in being able to defend each person they come across.

While in law school I had a good friend refer me to a paralegal position that he was leaving at an immigration and criminal defense office. While working for that office, I became the intake coordinator at the Mexican Consulate office in Los Angeles, and Santa Ana, California and being in direct contact with families and individuals I saw the cross section between immigration and criminal defense. It was there that I saw a vast majority of undocumented individuals, with no or limited English understanding, and no concept of the immigration consequences of their plea. They were often encouraged to plead guilty mistakenly believing it was their only choice. Many undocumented individuals in this country face a criminal case with no idea of the lasting implications of that case on their ability to remain in the United States and with their families. This consequence not only affects the person but separates families and people from their established lives. Having witnessed the affects of incarceration first hand, I sought to become an attorney that defends my undocumented clients to avoid further immigration consequences that will make them deportable.

Al principio quería ser defensora publica. Yo vi el efecto de la encarcelación de mi hermano cuando el tenía 18 años y fue sentenciado a prisión por un crimen que no cometió. Antes, mi meta era ser una defensora publica, pero después de los años me di cuenta de las limitaciones que ellos tienen para defender a cada persona que representan.

Durante mis estudios de leyes un amigo me recomendó a una posición de asistente legal en la oficina de defensa migratoria y penal en que el iba dejar. Durante mi tiempo en esa oficina, yo fui coordinadora de asesoría en el consulado de México en Los Ángeles y Santa Ana, California, y allí tuve contacto directo con familias y personas y logre ver  como cruzan las leyes migratorias y penales. Allí vi a muchas personas, la mayoría indocumentados con poco entendimiento de inglés, que no tenían entendimiento de los efectos migratorios de una declaración de culpabilidad.  Observe que muchas veces les recomendaron, a estas personas, que declararan culpabilidad y lo hacían, pensando que era su única opción. Muchas personas indocumentadas en este país se enfrentan un caso penal sin entender las consecuencias migratorias que tiene ese caso en su habilidad de permanecer en los Estados Unidos y con sus familias. Estas consecuencias no solamente afectan la persona pero separan sus familias y la vida que han establecido. Yo, teniendo el conocimiento de cómo una encarcelación puede afectar, me propuse ser una abogada que defiende a mis clientes indocumentados para evitar las consecuencias migratorias para evitar que sean deportados.

What do you find most challenging and most rewarding about your job?

The most challenging part of having a private practice is balancing different positions. I always have to be on top of things that include managing projects such as providing free legal clinics to share legal changes that may directly impact lives of many people.

I love being able to call my clients and inform them that their immigration case has been approved or that we closed their immigration proceedings and they do not have a deportation pending. Even when we do not have an immigration case pending clients call me to say thank you, I just got my drivers license. I feel like whatever way their lives are improved there is also a hope that is gained in knowing they are no longer in the shadows.

Lo mas difícil para mi, teniendo mi propia oficina, ha sido conseguir un balance entre todas las diferentes funciones de mi trabajo. Siempre tengo que estar pendiente de muchos proyectos más allá de los casos legales.  Por ejemplo, yo comparto información sobre los cambios legales en clínicas gratuitas para la comunidad Hispana.

Me encanta poder llamar a mis clientes y informarles de aprobaciones de sus casos o que su caso migratorio lo cerramos y no tienen deportación. A veces cuando no tenemos ningún caso migratoria pendiente mis clientes me llaman para decir gracias, recibí mi licencia. Me siento que en cualquier manera que pueda ayudar en beneficiar sus vidas también para darles esperanza en saber que ya no viven en la oscuridad.

What is your best survival tip for current law students?

Faith, balance, and doing what you love are working goals.

Faith in believing that God could get me through it even if the day was tiring or stressful.

Balance in all aspects of your life. Law school is not just books and classes but balancing your personal life as well.

Doing what you love is often stated in commencement speeches but it really applies to every part of your life even if it means changing careers or areas of legal interest in different moments of your life.

Fe, balance y dedicación para poder hacer lo que amas. Fe, creer que Dios me ayudaría a cumplir aunque el día había sido difícil o mucho estrés. Balance en todos aspectos de tu vida, la escuela no es solamente libros y clases pero balancear su vida personal. Y hacer lo que amas muchos dicen esto en graduaciones pero esto es algo que tiene sentido en todas partes de su vida aunque pueda ser cambiar carrera o área de interés legal en diferentes momentos de tu vida.

 For Latinas considering law school, what advice would you give them to succeed in their law school career?

You bring so much to the table; never let anyone intimidate you. Not only are your educational skills important but the assets of your life experiences are crucial to applying throughout law school. I always encourage Latinas to network and open up to different professional circles because you may never know what opportunities may be available. In my case, I did not have family or acquaintances as lawyers so it became especially important to establish connections with lawyers while in school. To this day my previous bosses have become an immense asset to my solo practice.

Tu contribuyes mucho y nunca dejes que te intimiden. No solo son importantes tus logros educacionales pero tus experiencias personales también son muy importantes durante tus estudios. Yo siempre recomiendo que Latinas vayan a eventos y compartan en diferentes círculos profesionales porque nunca saben que oportunidades están disponibles. En mi situación, yo no tengo familia o conocidos que sean abogados y por lo tanto, fue muy importante que yo estableciera esas conexiones con abogados durante mis estudios. Hasta el día los abogados con quienes trabaje han sido muy importantes como recursos en mi trabajo y para poder mantener mi propia oficina.

You ran for political office–can you give a little detail on the year you ran and why you decided to get involved in politics?

I ran for California State Assembly in 2010, while I was in law school. I was encouraged to run for office by the Green Party, as we were participating in an act of party awareness. It was more of a political statement to let voters know there is an alternative party, which encourages and supports female and young candidates. We didn’t do any door to door campaigning or fundraising, but we definitely reached 18.26% of voters against the incumbent. I would definitely consider running again with a campaign team. I think in it of itself it’s a statement that shows others that Latinas are stakeholders and should be in decision-making positions.

En 2010 fui candidata para la Asamblea de California durante el mismo tiempo que estuve en la escuela de leyes. Miembros del Partido Verde me sugirieron correr para esta posición porque estábamos demostrando otra alternativa para votar. Era una forma de protesta para educar a los votantes de otra alternativa, un partido que apoya a candidatos jóvenes y a mujeres. No tuvimos una campaña activa ni tampoco recaudamos fondos, pero si alcanzamos el 18.26% de votantes opuesto al titular. Definitivamente considero correr de nuevo pero con un equipo de campaña. Yo pienso que el correr para una posición es una forma de protesta que demuestra que Latinas también son contribuyentes y deben ser incluidas en las decisiones de la comunidad.

Finally, at Latinas Uprising, we focus on living a life well-lived.  What’s something you do (or try to do) to help reduce the stress in your life and create a healthy lifestyle?  

I believe my faith in God helps me reduce stress. I go to church and I sing worship songs on my car rides or at home. I find that when I build my faith my mind and focus is better, and I’m able to get through some difficult cases. I love to spend time with my 1 year old, by taking him to play activities or his swim classes. Just seeing his joy brings me a happiness that often times stress can cloud. Finding something outside of the law that you truly enjoy, and actually dedicating time to it will give you that breath of fresh air.

Yo creo que mi fe en Dios me ayuda reducir estrés. Hábitos, como ir a iglesia y cantar alabanzas durantes mis viajes en el carro cuando voy a corte o en casa me ayudan. Cuando yo fortalezco mi fe, mi mente y enfoque están preparadas para enfrentar casos difíciles. También me encanta compartir tiempo con mi hijo de un año, llevándolo a actividades o a sus clases de natación. Solo viendo su felicidad me da una felicidad que muchas veces el estrés impide. Buscar algo fuera de la ley que de veras te traiga felicidad y a lo cual le dediques tiempo, te dará el aliento que necesitas.
